New panel recycling regulations - what you need to know

The rules of the game in the renewable energy industry are changing faster than the weather in March. From April 1, 2025, every small installation company from Łódź and the surrounding area must have hard papers on what happens to used modules, otherwise financial penalties will eat the margin from three large orders. No unnecessary talk — I'll explain to you how to prepare the warehouse and documentation so the official has nothing to complain about.

End of 'the client's problem' – new responsibility

Until now, many assembly teams believed that what remained after replacing old panels with new ones was the property owner's problem. Often these panels ended up in a corner of the garden or under the fence, waiting for better times. New regulations cut short this practice. Now you, as installers, formally become the 'waste generator' at the moment of dismantling. This means that every piece of glass and silicon must be entered into the BDO system within exactly 48 hours of completing the work at the client's site.

At Polish Wings of Development we analyzed 14 recent inspections in our region and the conclusion is one: the Environmental Protection Inspection is now checking the consistency of invoices with waste transfer cards (KPO). If the invoice issued to the client shows the item 'dismantling of 23 panels', and there is no trace of these 414 kilograms of waste in your BDO register, the system automatically flags the company for control. It simply pays off – it's better to spend 14 minutes on an entry in your phone than to pay a penalty that now averages 11,800 PLN for failing to keep reliable records.

Honestly, most of you already have a BDO account, but few use it every day. From next quarter, this will change because new waste codes specific to domestic photovoltaics will enter into force. It will no longer be possible to throw everything into one bag with electronics. Every element, from the inverter to the aluminum frame, is to have its place in the digital log. Our field team in Łódź is already testing a simplified procedure that allows formalities to be closed directly on the client's roof.

Real recycling costs in 2025

Let's check the specific numbers, because you ask about them most often. Currently, the cost of legal recycling of one ton of panels in plants near Zgierz or Pabianice oscillates between 840–960 PLN net. To this must be added transport. For a small company that does 4–6 installations a month, these costs become noticeable in the annual settlement. If you think it can be ignored, I warn you: fines for taking panels to 'ordinary' scrap yards have increased to 23,400 PLN. This is not a scare tactic, it is a legal reality we must face.

We operate on hard data and see that companies that have signed permanent contracts with waste processing points pay about 17% less than those looking for a recipient 'now'. It is worth negotiating a flat rate for collection, even if you only generate 147 kg of waste per month. Also remember that from April the so-called product fee will increase. This means that producers and importers will pass the recycling costs on to you, and you must include this in the cost estimates for end customers so you don't pay extra for the business.

You may have heard of 'free' collections organized by some associations. (Heads-up: make sure twice that such an entity issues a full KPO card). Without this document, in the eyes of the law, the panel is still with you, even if it has physically left the base. We had a case of a client from Bałuty who gave 83 old panels to an 'acquaintance', and then for 4 months straightened the matter out in the marshal's office because he had no confirmation in the system. It simply does not calculate.

Changes in storage – 90 days and not a day longer

The amendment also introduces a rigid time frame for keeping damaged modules at your own base. From the moment of dismantling at the client's site, you have exactly 90 days to hand them over to a certified processing plant. Previously, the regulations were quite vague on this point, which allowed some to hoard waste under a shed for a year. Now, every inspection will start with a question about the date the waste was received. If you exceed this deadline by even 3 days, the BDO system will send an automatic notification to the inspectorate.

Storage must also meet specific safety standards. Panels cannot lie directly on the ground – pallets and protection against leakage of substances into the soil are required, although with silicon the risk is small, the regulations are ruthless. Often, changing the yard organization by 12 square meters is enough to have everything in accordance with the letter of the law.

It's also worth mentioning what happens to panels damaged in transit. They are also subject to the same rigors. If 7 modules broke during unloading, you cannot just throw them into a rubble container. They must be recorded as damaged goods and disposed of in the same way as the 10-year-old models taken off the roof. Documentation must match to the kilogram – officials allow a measurement error of only 3.2%, which gives a very small margin for error for a ton of waste.

How to prepare for the annual report?

The biggest trap awaits you on March 15 each year. This is the final deadline for submitting the BDO annual report. If you leave it to the last minute, the government servers will crash, and you will be left with an unfinished application. We recommend doing monthly summaries. This takes about 24 minutes once a month and saves weeks of stress in March. Remember that the report must take into account not only the weight, but also the countries of origin of the components if you are the importer yourselves. This applies to an increasing number of small companies from Łódź that import pallets directly from the port in Gdynia. If you buy from Polish wholesalers, make sure they provide you with the producer's BDO registration numbers. Without this, you will not close the report correctly. This is a trifle that 47% of beginner installers forget about, and which blocks sending documents at the last moment.

Finally, a little tip: check the email inbox assigned to your BDO account regularly. Offices are increasingly sending requests for explanations electronically. No reply within 7 business days is the easiest way to get a visit from a controller in the office. Our experience shows that a quick response to an email can nip the problem in the bud. There were cases where it was enough to send one photo of the label from the panel for the official to close the case in 2 hours without further questions.

A monthly summary takes 24 minutes. Stress in March lasts for weeks.
How to prepare for the annual report?

Concrete steps for the next 2 weeks

Don't wait until April. The first step is a review of inventory at your base. If you have old panels there, get rid of them now, under the old rules, while queues to the collection points are still short. Second step: check permissions in BDO. If you logged in there a year ago, it may turn out that the password has expired or the profile is not fully verified with a Trusted Profile. These are technical trifles that can take 3 business days at the most inappropriate moment.

Third issue: update contract templates with clients. Add a short clause stating that your company takes responsibility for the disposal of dismantled elements. This builds a professional image and reassures clients who have heard in the media about problems with recycling.
